Terms of Service

Last updated: September 15, 2026

These terms govern your use of NimbleFax. By creating an account or using the service, you agree to them. We've written them in plain language; if anything is unclear, email support@nimblefax.com before relying on it.

The service

NimbleFax lets you send and receive faxes over the internet without a fax machine. You upload a document, we transmit it to the destination fax number over the telephone network, and we deliver inbound faxes to your online inbox.

Fax delivery depends on telephone carriers and the receiving machine or service. We confirm delivery when the receiving side acknowledges transmission, but we cannot guarantee that any particular fax will be delivered, or delivered within a particular time.

Accounts

You must provide an accurate email address and keep your account credentials confidential. You are responsible for activity on your account. One person or business per account; if several people need access, each person should have their own login on the account.

You must be at least 18 years old and able to form a binding contract to use NimbleFax.

Credits and pricing

Sending faxes consumes page credits. Pay-as-you-go pages are priced as shown on the pricing page at the time of purchase. Credits purchased in advance do not expire while your account remains active and in good standing.

You are only charged for pages that are successfully transmitted. If a fax fails after all retries, the credits for that fax are not deducted.

Credits are not redeemable for cash and are not transferable between accounts, except where required by law.

Subscriptions

The flat monthly plan renews automatically until you cancel. You can cancel at any time from the billing page; cancellation takes effect at the end of the current billing period, and no further subscription charges will occur. We do not prorate or refund partial billing periods, except where required by law.

The flat plan is intended for normal business use and includes a fair-use page allowance shown on the pricing page. If usage far exceeds that allowance, we may contact you to move you to a plan that fits, and in extreme cases may suspend the flat-rate allowance for the remainder of the period.

Dedicated fax numbers

You may purchase a dedicated inbound fax number. If you stop paying for a dedicated number, we hold it for a grace period before releasing it. Once released, a number may not be recoverable, and we may decline to reassign a recently released number to a new customer for a cooling-off period to protect the previous owner.

You do not own telephone numbers assigned through the service; they are provided for your use while your account is in good standing.

Acceptable use

You agree not to use NimbleFax to:

  • Send unsolicited bulk faxes or junk faxes, in violation of the Telephone Consumer Protection Act (TCPA), the Junk Fax Prevention Act, or similar laws.
  • Send content that is unlawful, fraudulent, defamatory, or infringes others' rights.
  • Harass, threaten, or impersonate any person or organization.
  • Probe, scan, or test the vulnerability of the service, or interfere with its operation.
  • Resell the service without our written permission.

Violating this section may result in immediate suspension or termination of your account.

Your content

You retain all rights to the documents you send and receive. You grant us the limited right to transmit, store, and display your documents solely as needed to operate the service for you. You represent that you have the right to fax the content you send and that doing so complies with applicable law.

Medical, legal, and regulated use

NimbleFax may be used to transmit documents containing sensitive information, but we do not currently sign Business Associate Agreements (BAAs). If you are a HIPAA covered entity or business associate, you are responsible for ensuring your use complies with HIPAA. Do not rely on NimbleFax as your sole record of legally critical transmissions — retain your own copies and confirmations.

Service availability and changes

We aim for high availability but do not guarantee uninterrupted service. Maintenance, carrier issues, or circumstances beyond our control may cause interruptions. We may update features or these terms; if a change is material, we will give notice by email or in the app, and continued use after the change means acceptance.

Disclaimers and limitation of liability

The service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

To the maximum extent permitted by law, NimbleFax will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim arising from the service is limited to the amount you paid us in the twelve months before the event giving rise to the claim, or $100, whichever is greater.

Termination

You can close your account at any time by contacting support. We may suspend or terminate accounts that violate these terms, abuse the service, or fail to pay amounts due. On termination, your right to use the service ends; we may retain records as required by law or legitimate business need, per our Privacy Policy.

Governing law

These terms are governed by the laws of the State of California, excluding conflict of law rules. Any dispute will be resolved in the state or federal courts located in California, unless applicable law requires otherwise.
